The Manager shall convene the first meeting of all the Owners within 9 months of the execution of the Deed of Mutual Covenant to establish an Owners' Committee. |
| (2) |
All Residential Units shall be used for private residential purpose only and shall not be used for any illegal or immoral purpose. |
| (3) |
No Owner shall make any structural alteration to any part of the Estate owned by him which may damage, affect or interfere with the use and enjoyment of any other part or parts of the Lot or the Estate by other Owners. |
| (4) |
No owner shall do or permit to be done any act or thing which may or will alter the facade or external appearance of the Estate without the prior consent in writing of the Manager. |
| (5) |
No air-conditioning or other units shall without the prior written consent of the Manager be installed through any window or external wall of the Residential Development other than at places designated for such purpose. |
| (6) |
No Owner except the Owner having the exclusive right to use and occupy the flat roof or a specified part of the roof which forms part of his Residential Unit shall have the right to use the flat roof or that part of the roof except in the event of fire or emergency. Subject to the rights reserved to the First Owner, no Owner shall erect any advertising signs or other structures on the roof and/or flat roof. |
| (7) |
Live poultry, birds or animals may be kept in a Residential Unit as pets unless the same has been the cause of reasonable complaint (in the sole discretion of the Manager) by at least two Owners or occupiers of any part of the Estate. |
| (8) |
No Owner shall enclose the balcony and/or utility platform of his Residential Unit wholly or partially, nor shall he use it for any purpose other than as a balcony or an utility platform. |
| (9) |
The Owners shall at their own expense maintain and
carry out all works in respect of any and all slopes,
slope treatment works, retaining walls and other structures
(collectively referred to as the "slope structures")
within or outside the Lot as required by the Government
Grant
and in accordance with "Geoguide 5 - Guide to Slope
Maintenance" issued
by the Geotechnical Engineering Office (as amended from
time to time) and the Maintenance Manual(s) for the slope
structures. |
| (10) |
All Owners of the Lot and the Estate shall hold their respective part or parts of the Lot and the Estate or any undivided share therein subject to and with the benefit of a Lease made between the First Owner and Jensome Technology Limited in respect of certain conduits, trunkings and areas in the Estate for the installation and operation of communal aerial broadcast distribution network and telecommunication network in the Estate. |
| (11) |
No Owner shall carry out or permit or suffer to be carried out any building works (as defined in the Buildings Ordinance (Cap.123)) involving the structure (including floor slabs) of the Estate or any part thereof except with the prior written approval of the Building Authority under the Buildings Ordinance (Cap.123) and any other Government authority (if required). |
