| MAIN PROVISIONS OF THE DEED
OF MUTUAL COVENANT |
| (1) |
The Manager shall convene the
first meeting of all the Owners within 9 months of the execution
of the Deed
of Mutual Covenant to establish an Owners' Committee and to
elect a chairman. |
| (2) |
All Residential Units shall be used for private
residential purpose only and shall not be used for any illegal
or immoral purpose. |
| (3) |
No air-conditioning or other units shall
without the prior written consent of the Manager be installed
through any window or external wall except at places designated
for such purpose. |
| (4) |
No Owner except the Owner having the exclusive
right to use and occupy the flat roof or a specified part of
the roof which forms part of his Residential Unit shall have
the right to use the flat roof or that part of the roof except
in the event of fire or emergency. Subject to the rights reserved
to the First Owner, no Owner shall erect any advertising signs
or other structures on the roof and/or flat roof. |
| (5) |
Pets may be kept in a Residential Unit unless
the same has been the cause of reasonable complaint by at least
two Owners or occupiers of any part of the Estate. |
| (6) |
No Owner shall enclose the balcony and/or
utility platform of his Residential Unit wholly or partially,
nor shall he use it for any purpose other than as a balcony
or an utility platform. |
| (7) |
Until such time as the Plant has ceased operation
or has been relocated elsewhere, full right and liberty for
the First Owner to continue using the Reserved Portion for
all lawful purposes for and in connection with the operation
of the Plant including but not limited to the transportation
of naphtha from barges to the marine jetty at the seafront
of the Reserved Portion and via pipeline underneath San Ma
Tau Street to the Plant or any other part thereof. |
| (8) |
The Owners shall at their own
expense maintain and carry out all works in respect of any
and all slopes, slope
treatment works, retaining walls and other structures (collectively
referred to as the "Slope structures") within or outside the
Lot as required by the Government Grant and in accordance with
"Geoguide 5 - Guide to Slope Maintenance" issued by the Geotechnical
Engineering Office (as amended from time to time) and the Maintenance
Manual(s) for the slope structures. |
| (9) |
All Owners of the Lot and Estate shall hold
their respective part or parts of the Lot and Estate or any
undivided share therein subject to and with the benefit of
a Lease made between the Developer and Jensome Technology Limited
( 捷 星 科 技 有 限 公 司 ) in respect of certain conduits, trunkings
and areas in the Estate for the installation and operation
of the telecommunications network in the Estate. |
